Acceptable Use Policy

This document describes the obligations and liabilities that are partof owning your personal internet account. We hope to give you a clearguide of what to expect and how to behave. By using the SolutionProAccess Port, you agree to abide by the rules set forth below and byany other rules deemed necessary.

1. PRIVACY. SolutionPro has every intention to keep all aspects ofyour account private, but it is impossible for us to guarantee thatany activity done while using our access service will be completelyprivate. If you use data encryption you may possibly increase yourdegree of privacy. It is necessary for you to take personalresponsibility for the privacy of your use of your account on theInternet, and to take any actions you deem necessary to protect yourprivate information.

2. RESPONSIBILITY. You are personally responsible for all informationor representations you make under your account. The choice of yourpassword is part of this responsibility. Protect your account. Justlike you would not let others knowingly mis-use your telephone, youare not authorized to share your SolutionPro Internet Access accountwith any others. Violators will have their access terminated withoutrecourse.

3. ILLEGAL ACTIVITY. While using SolutionPro’s Access Port, you mayfind opportunities to engage in unlawful actions. We cannot stop youfrom accessing data on remote sites all over the world, much like thetelephone companies cannot prevent you from dialing any number in theworld. If however, you are caught violating any local, state orfederal law, you will have your account terminated without recourse.

4. PORNOGRAPHY. It is possible during your connection to the computernetworks of the World Wide Web that you may encounter material deemedobscene or pornographic. It is possible for you to filter out, or NOTaccess those things which you might find offensive. Only you candetermine your access and what is or is not objectionable material.Access to materials does not give you permission to own any materialthat is in violation of local, state or federal laws. This isespecially applied to those materials such as pornographic pictures asdefined under local, state or federal laws. You are hereby notifiedregarding access to so-called pornographic materials, and hereby agreeto accept all responsibility regarding this matter.

5. NET ETIQUETTE. It is your responsibility to keep from offendingothers and to learn proper net etiquette. Severe violations of netetiquette can result in you and the system administration beingflooded with mail in response from around the world. If you cause sucha severe violation you may have your account terminated withoutrecourse. Any complaints from other users will be dealt with on a caseby case basis.

6. ADVERTISING. It is possible to create successful advertising on theInternet, but some ways are NOT permitted. You may NOT sendunsolicited e-mail to users concerning your product unless you providea working opt-out solution so that users can be removed from your listif they choose not to receive your material. You may NOT post messagesin news groups that are not related to your product or service, forexample posting to alt.apples about oranges.

7. USER AGE LIMITS. Users under the age of 18 may not access thisservice without the express permission of their parents or guardians.

8. ACCOUNT PAYMENT. Your account payment is due by the set date (setat the time you are entered into the system and able to log on to youraccount) of every billing cycle. Any account will be shut off afterten (10) days of non-payment status. All shut-offs will require a newset-up fee of $20.00 to reinstate their accounts. There will be a$20.00 returned check fee on all returned checks. The internet accessaccount will be closed until all fees are paid in full. Outstandingaccount balances will be charged at the highest allowable interestrate under Idaho law. User agrees to and is responsible for allcollection fees, if SolutionPro must seek collection from user on saidaccount. A 30 day notice is required for account closure. To makechanges on your account requires a 15 day prior notice. We reserve theexpress right to refuse service or cancel service to anyone with orwithout reason.

9. USER AGREEMENT. I am responsible for what happens with mySolutionPro account for Internet Access Service. I hold SolutionPro,its Owner, contractors and employees without harm for any activitiesin connection with the use of my account. I understand that thisservice account can potentially access the items described above. Iunderstand that it is my responsibility to censor and regulate theaccess to computer data available to my child or any other childrenthrough the access of my Internet account. I agree that it is not theresponsibility of SolutionPro, its owner, contractors or employees.

10. TOTAL AGREEMENT. I/we understand that SolutionPro has no controlover the content of the information available on the Internet or theWorld Wide Web. I/we also understand that due to the nature ofelectrical and electronic equipment with which the Web functions,SolutionPro cannot guarantee access to any service at any time.SolutionPro agrees to maintain its access to the Internet to the bestof its abilities, but has no control over other servers or powersuppliers. SolutionPro reserves the right to review at any time andmaintain the right to retain exclusive control of all materialsavailable over its server networks and equipment and may remove anymaterial deemed unacceptable according to any current legal and/orsocial standard. The term of this agreement shall be for one year, andshall be automatically extended for one year unless either partynotify the other in writing with a 30 day minimum notice oftermination. I have read and agree to the terms on the front and backof this form.

Rights and Obligations of Customer
SolutionPro has setup this AUP to protect ourselves and our clients.As a SolutionPro client or system user, you are responsible forreading, understanding and following these policies and should acceptthe responsibility of reporting any abuse you suspect or witness toabuse@noc.spro.net or use this form. If you do not agree with thesepolicies please contact us immediately to cancel your service with us.

These policies are in addition to any and all agreed upon terms setforth between SolutionPro and our clients in any contracts that mayhave been signed by both parties.

Limitations
These policies represents guidelines for the acceptable use of theSolutionPro services for data communications. It is intended to beapplicable only to the use of SolutionPro’s networks and computersystems.

In such instances where data communications leave SolutionPro’snetwork and are carried by other networks or the Internet, theacceptable use policies of other networks are applicable, and must berespected.

SolutionPro shall assume no responsibility for any of our clientsactions, nor the actions of persons accessing our network or computersystems from outside our organization.

Acceptable Uses
All items covered/mentioned under this section, “Acceptable Uses”, ofSolutionPro’s AUP shall NOT include any and all activity that isconsidered illegal as governed by the laws of the United States ofAmerica and/or the State of Idaho.

* Websites - Acceptable use of websites on SolutionPro’s networkor computer systems shall include the use for personal, commercial, orother advertising, display or promotion of any material as long as itdoes not interfere with the services, network, or computer systemsowned and operated by SolutionPro or other organizations and as longas any information you make available is true and not misleading. As aclient you are allowed to rent advertising space in the form of banneradvertisements, limited to a maximum of one banner per web page, butnot resale of your website space to another organization.

* FTP Space - Acceptable use of FTP space on SolutionPro’snetworks and computer systems shall include the use for transfer byour clients TO and FROM our computer systems electronic media forplacement on the Clients Website or FTP Space for download by them orother persons through the Internet as long as any information you makeavailable is true and not misleading.

* Email - Acceptable use of the SolutionPro’s networks andcomputer systems for the transmittal of electronic mail shall includefor commercial or private use for the normal communication of ideas,information, correspondence, and data transmittal.

Unacceptable Uses

* All items covered/mentioned under this section, “UnacceptableUses”, of SolutionPro’s AUP shall include any and all activity that isconsidered illegal as governed by the laws of the United States ofAmerica and/or the State of Idaho.

* Websites - Unacceptable uses of websites on SolutionPro’snetwork or computer systems shall include the display of any and allmaterial in any form containing any of the following:

* Anything that is in direct contradiction with any ofSolutionPro’s Acceptable Uses Policies.
* Pornography.
* Vulgar material as viewed by today’s standards.
* Any material that outlines or details how to perform any illegalactivities.
* Any material that could infringe on or disrupt the services ofanother organization.

FTP Space - Unacceptable uses of FTP Space on SolutionPro’s network orcomputer systems shall include making available for download any ofthe following:

* Anything that is in direct contradiction with any ofSolutionPro’s Acceptable Uses Policies.
* Pornography.
* Vulgar material as viewed by today’s standards.
* Any material that outlines or details how to perform any illegalactivities.
* Any material that could infringe on or disrupt the services ofanother organization.
* Warez - Pirated software.
* Other unacceptable uses shall include the attempt to gainillegal access to SolutionPro’s network or computer systems in anattempt to disrupt service, hack, crack, or in any way attempt toaccess areas of the SolutionPro’s network or computer systems whereyou are not normally allowed.
* Email - Unacceptable uses of SolutionPro’s network or computersystems for delivery of electronic mail shall include the sending ofunsolicited bulk mail messages (junk mail or spam). This includes, butis not limited to, bulk-mailing of commercial advertising, andinformational announcements. Such material may only be sent to thosewho have explicitly requested it. Harassment, whether throughlanguage, frequency, or size of messages. Forwarding or otherwisepropagating chain letters, whether or not the recipient wishes toreceive such mailings. Sending malicious email, including but notlimited to “mail bombing” (flooding a user or site with very large ornumerous pieces of email). Forging of e-mail header (envelope)information. Any attempt to forward mail through the SolutionPro’snetwork or computer systems.

SolutionPro does not allow forwarding of email through oursystems. We also do not allow anonymous sending of email using oursystems.

Miscellaneous

* Performing any activity that could disrupt service in any way isnot allowed.

Right of RefusalNotwithstanding any other provision of these guidelines, SolutionProreserves the right to decline to provide service to any user for anyreason, including, but not limited to inappropriate postings,uploading and the inclusion of objectionable material in web pages.

If SolutionPro deems that the policies outlined above are not beingfollowed, for any reason, we reserve the right to suspend service forat least one week, without refund of credit for such time ofsuspension and request that the problems be fixed. If at the end of areasonable time of suspension the problem is not fixed satisfactorilyby SolutionPro’s judgment termination of the offending account will beIMMEDIATE, PERMANENT, and without refund.

Modifications to these policiesSolutionPro reserves the right to make modifications to any of thesepolicies at any time without prior notification.

Complaints… regarding the violation of any of the above conditions by any ofSolutionPro’s networking clients, should include notification to theSolutionPro Security/Abuse Response Team ( abuse@noc.spro.net )
